Application rules



Applicants must read these terms carefully before applying for the QWS Challenge. By applying for this program, you are deemed to have agreed to the terms of this agreement.

This program is sponsored by Shibuya Scramble Square Co., Ltd. (hereinafter the organizer).

1. How to apply

This program accepts project applications online using the WEB system of the award platform "AWRD" operated by Loftwork Inc. AWRD account registration is required for entry (free of charge). Applicants must apply according to the application method specified in the application guidelines for this program.

2. Intellectual property rights

All ideas submitted by applicants to this program, all "text, sketches, diagrams, 3D data, CG data, photos, audio, video, software, prototyping hardware and any other products" (hereinafter referred to as "products") created during the course of the project, and all copyrights related to those products (including the rights of Article 27 and 28 of the Copyright Act and other rights), patent rights, utility model rights, design rights, trademark rights, intellectual property rights (including patents, utility models, design registration rights, etc. Hereinafter collectively referred to as "intellectual property rights") and all other rights belong to the applicant.

In the event that an idea is judged to be suitable to conduct proof-of-concept experiments and commercialization of ideas by the program organizers, co-organizers, selection committee members, and other parties who cooperated with the program (hereinafter referred to as "organizers"), the applicant will cooperate in consultation with the organizers.

3. About publishing ideas

Organizers can publish products and ideas on websites (including SNS), flyers, pamphlets, etc. for promotional purposes or research purposes. The applicant shall not make any money or any other claim for the publication, nor shall they make any third party claim.

4. Confidential information of applicants

Applicants should fully understand the handling of ideas and products in this program as defined in sections 2 and 3, and be careful not to provide confidential information that they wish not to be disclosed. However, if an applicant wishes to provide such confidential information to the program, the organizer will be notified in advance and the handling of such information will be discussed.

5. About the organizer's confidential information

During the course of the program, if the organizer provides the applicant with confidential information clearly indicating that it is confidential, the applicant shall follow the instructions of the organizer regarding the handling of the confidential information.

6. Handling of personal information

Applicants permit the sharing of personal information (information entered in the application form of the program) with parties involved in the program.

7. Compliance with rules and regulations

Applicants must comply with the rules and regulations of the organizers and the manager of the facility where the program is conducted (hereinafter referred to as "the facility"), regarding the use of equipment, machines, devices, tools, etc. at the facility.

8. Damage to equipment

If an applicant damages equipment, machines, devices, tools, etc. at the facility, intentionally or through negligence, the applicant may be required to pay the repair/replacement costs.

9. Notes

9-1 Prohibited matters

• When using materials created by third parties (art, photographs, fonts, etc.) in ideas created in the program, the copyright and portrait rights must be obtained from the author. If materials that infringe on the rights of third parties are used, they will not be selected once they are discovered. In addition, even if a third party makes an allegation of infringement or seeks compensation for damages from applicants or parties related to this program, the parties related to this program will not be held responsible.

• Applicants shall not violate any laws or public order and morals regarding production activities in this program, and shall not infringe on any third-party intellectual property rights or any other rights.

• Any acts that conflict with Japanese domestic and international law are prohibited. The act of causing physical or mental damage to a third party, the act of defaming a third party's honor, and the act of infringing any third party's rights are prohibited. In addition, any act that violates public order and morals is prohibited.

9-2 Disclaimer

• If an applicant suffers damage to their person or property due to an accident during the program or a dispute between applicants, the applicant will bear responsibility for the damage and must not claim any form of compensation from the organizer. However, this does not apply if the organizer has commit intentional or gross negligence relating to the occurrence of the damage.

• We are unable to respond to any inquiries regarding the acceptance status and results of applicants.

10.Other

• If an applicant violates the provisions of each of the above paragraphs and causes damages to the organizer or a third party, they will bear the responsibility and burden and resolve the matter on their own, without causing the organizer to be inconvenienced or burdened, and without requesting compensation for damages.

• The organizer of this program may change the contents of these application rules at any time without obtaining the consent of the applicant.

• Matters not described in this notice will be decided at the discretion of the organizer after discussion with the relevant parties of this program.

• Personal information submitted by applicants will be handled in accordance with the Act on the Protection of Personal Information (Personal Information Protection Act), and will not be used for purposes other than this program or provided to third parties without the consent of the applicant.
