Application Rules / BUSINESS ALLIANCE

The Rules set forth matters concerning the “Project” hosted by the “Sponsor”, who is under entrustment from the “Entrustor”.

For people who intend to apply to the Project (the “Applicant”), please make sure to read the Rules carefully. By submitting the work (the “Entry”) to the Sponsor and applying to the Project, the Applicant shall be deemed to have agreed on the content of the Rules.

1. Application procedure

(1) The Project invites Applicants online, by using the web system of award platform “AWRD” operated by Loftwork Inc. (“Loftwork”, and collectively with the Sponsor and the Entrustor, the “Project Related Persons”). In order to apply to the Project, the account registration to AWRD is necessary (Please see the Terms of Use of AWRD.).

(2) The Applicant needs to make sure to follow application procedure prescribed in the application guidelines of the Project. The Sponsor may decline the submission of the Entry which does not follow the application procedure prescribed in the application guidelines.

2. Entry

(1) The Entry must be created by the Applicant himself/herself,

(2) The Applicant represents and warrants, that the Entry does not violate or is not likely to violate any rights of the thirdparty including intellectual property rights.

(3) If the Entry includes material prepared by a third party other than the Applicant (including, but not limited to, arts, images and fonts), the Applicant shall obtain clearance of rights, such as to obtain the permission of such third party, at its own expense and responsibility.

(4) If the Sponsor considers that the Entry violates or is likely to violate the rights of the third party, the Sponsor may exclude it from the examination.

(5) If a third party claims violation of rights to the Project Related Persons in relation to the Entry, the Applicant shall defend and indemnify the Project Related Persons at its own expense and responsibility.

(6) If the Project Related Persons covered the damage compensation or cost based on the third party’s claim of rights violation, the Applicant shall compensate the full amount, regardless of the name.

3. Rights of the Entry

(1) Except as otherwise prescribed in the Rules or in the separate agreement, the Applicant shall retain the rights in relation to the Entry including intellectual property rights, and to the extent it does not violate the Rules, the use of the Entry shall not be restricted.

(2) The Applicant shall permit the use of the Entry without any cost in the following situation.

(a) When the Sponsor uses for the purpose of the Project hosting

(b) When the Entrustor uses for the purpose of advertisement of its business

(c) When Loftwork uses for the purposes of advertisement of Loftwork

(3) The Sponsor may use the Entry in other means than set forth above after the consultation with the Applicant, and the details of condition shall be discussed separately and agreed on.

4. Winning Entry

(1) The Sponsor shall examine the Entry, and by its own judgement, select the winning entry of the Project (the “Winning Entry”) and make announcement by an appropriate means.

(2) The Sponsor may exclude from examination a work which does not follow the application procedure or specification prescribed in the application guidelines. In addition, if the fact became evident after selected as a Winning Entry that the work was not eligible for examination, the Sponsor may cancel the selection as the Winning Entry.

(3) The Sponsor may decide that there is “No Winning Entry” if there is no Entry which is worth winning, as a result of examination

(4) The Sponsor has no responsibility in relation to the examination results, and has no obligation to respond to any inquiry from the Applicant about the examination status and the results.

5. Business or technical information

The Applicant shall not use business or technical information of the Project Related Persons which can be known through the application to the Project for purpose other thanthe application to the Project, without prior permission by the Project Related Persons.

6. Handling of personal information

The Sponsor shall handle the personal information of the Applicant, in accordance with the Act on the Protection of Personal Information (including relevant Cabinet Orders, rules and guidelines, the “APPI”), to the extent necessary for achieving the following purposes.

(a) Inquiry from the Sponsor

(b) Notice of examination results from the Sponsor to the Applicant

(c) Provision from the Sponsor to the Entrustor

(d) Use of the Winning Entry at the Entrustor

(e) Project notification from the Sponsor to the Applicant

(f) Other matters which are reasonably relevant to (a), (b), (c), (d) or (e) (including in the case when the Sponsor provides the personal information to a third party)

7. Points to note

7-1 Prohibited Items

(1) The Applicantshall not take the following actions.

(a) Action which violates the Rules

(b) Action which violates or is likely to violate the rights of the third party including intellectual property rights

(c) Action which causes physical or mental harm to the third party

(d) Action which defames the third party

(e) Action which violates laws and regulations

(f) Action which disturbs public order

(g) Action which is equivalent to (a), (b), (c), (d), (e) or (f).

(2) If the Applicant violates the Prohibited Items or the Sponsor considers it is likely to violate the Prohibited Items, or if the Applicant is recognized as an organized crime group, Sokaiya or other antisocial organization (a group or individual who pursues economic interests by using violence, power or fraudulent means) or equivalent, the Sponsor may exclude such Applicant’s Entry from examination and cancel the participation in the Project.

7-2 Disclaimer

(1) If the Applicant suffers damage in relation to the Project, such damage shall be fully assumed by the Applicant, and the Project Related Persons shall assume no responsibility.

(2) If the Applicant violates the provisions of the Rules and caused any damage, loss or cost to the Project RelatedPersons, the Applicant shall compensate the full amount.

8. Other matters

(1) The Sponsor may change the content of the Rules any time, by notifying using appropriate means such as email. At the point of login, the Applicant shall be deemed to have agreed to the latest Rules as of then.

(2) The matters not indicated in the Rules shall be determined by the Project Related Persons.


Instagram Application Rule

The Rule sets forth matters concerning the “Project” hosted by the “Sponsor” (as defined below), who is under entrustment from the “Entrustor”.

For people who intend to apply to the Project (the “Applicant”), please make sure to read the Rules carefully. By submitting the information required for application (“Entry Data”) to the Sponsor and applying to the Project (“Application”), the Applicant shall be deemed to have agreed to the content of the Rule.

  • Meta is not involved in the Project or the call for applications in connection with the Project.
  • The Application is a project sponsored by Nissan Motor Co., Ltd. ("Sponsor").
  • The Application may be cancelled, suspended, or terminated due to system maintenance, malfunctions, or other reasons without prior notice.
  • To apply to the Project, you must have an Instagram account ("Account").
  • Winners will be notified by DM (direct message) from the administrator account to the winning Account.

Application procedure

(1) The Project invites Applicants online via Instagram, by using the web system of the award platform “AWRD” operated by Loftwork Inc. (“Loftwork”, and collectively with the Sponsor and the Entrustor, the “Project Related Parties”). In order to apply to the Project, a public account of Instagram is necessary.

(2) The Applicant needs to make sure to follow the application procedure prescribed in the application guidelines of the Project. Any application which does not follow the application guidelines will be invalidated and the Sponsor may decline the submission of such Entry Data.

Application requirements

  • The Applicant must have agreed to the terms and conditions of Instagram and created an Account.
  • The Applicant must have agreed the Rules and the AWRD Terms of Service (https://awrd.com/en/terms-of-s... Applicant must have an Account and have set the account as a public account.

* Please be aware that your application will be invalidated if your Account is private, if your post is not searchable, or if you have deleted from your post your application.

* If you do not have an Account, please create one before you apply. When creating an Account, please read the terms of use of the applicable services by yourself. Instagram(https://www.instagram.com)

Important notes regarding Entry Data

  • All images, videos, and texts posted (Entry Data) may be published on our website.
  • If you wish to have your published Entry Data deleted, please contact the account administrator (@awrd_com) via DM. (*Your Application will not be invalidated.)
  • Entry Data may be used on the website, social network account, and other promotional materials managed by the Project Related Parties as part of future promotional activities of the Project Related Parties. In such cases, you will be contacted via DM to your Account to obtain permission to use your Entry Data.
  • The original image and video data taken may be required when your Entry Data is awarded, so please do not delete your Entry Data until the results are announced. If the original image is deleted and cannot be provided, the award may be withdrawn.
  • If there is any infringement of third-party rights, such as portrait rights, in the Entry Data, the Project Related Parties will not be liable for any such infringement. If the Entry Data includes the image of a person, please obtain permission from the subject and photographer before posting. Please post images, videos, and texts at your own risk. If any Project Related Parties or any third party receives any complaint or other action due to Entry Data posted by an Applicant, the Applicant may be required to bear the costs incurred in resolving such complaint or other action.
  • If you are affiliated with an entertainment agency or talent agency please consult with the agency in advance and obtain their consent to the Rules and permission for your application before making an application. Should there be any inquiry after the publication of your application, the Project Related Parties will not be liable for such inquiry.
  • Please do not post images that infringe copyrights, are intended for business or commercial purposes, involve political activities, involve religious activities, are associated with crimes, are disturbing in light of public order and morals, or are offensive to the viewer.
  • The Project Related Parties will not be liable for any loss, liability, damage, expenses, or other claim arising out of or in connection with the application to the Project.

Notes regarding Instagram

  • If you delete your Account or unfollow "@awrd_com," the administrator will not be able to send you DMs, and your winning application will be invalidated.
  • The Project Related Parties will not indemnify you for any loss or damage you may suffer as a result of the use of your Entry Data by a third party, nor will they be liable for other loss or damage otherwise incurred by you.
  • You may be disqualified in the following cases:
    • Your Account is private;
    • There is no profile, user name, or image;
    • There is no action (such as post, reply, or the like);
    • E-mail address has not been verified after Account creation;
    • Application was made immediately after Account creation;
    • Unfollowing @awrd_com before the announcement of the award winners;
    • Account name or @username is changed during the event period.
      * Awarded users are requested not to change their Account name or @username until communication related to the award has been consummated. If you change your Account name or @username, we may have difficulty identifying your Account and may not be able to contact you as necessary.

Prohibitions

An application from an Account that falls under any of the following descriptions may be invalidated.

If any of the following are found to be the case after the award is made, the award may also be invalidated or withdrawn.

  • An application from an Account that violates Instagram's terms of use;
  • An application made using an automated program;
  • Applications made from multiple Accounts;
  • Any activity that interferes with the operation of this campaign;
  • Slander or defamation of a specific organization or individual;
  • Any act that is disturbing in light of public order and morals;
  • Act of advertisement or solicitation;
  • Any other acts on the part of the Applicant that the administration office determines to be inappropriate.

Handling of personal information

  • We may ask for individual contact information and contact you separately for the purposes of 2. " Communication to you from our website and co-users," 3. " Ordering of production work such as design and manuscript production," and 6. " Communication about projects sponsored by our website and co-users," in addition to contacting you after you have received an award. Any personal information (e.g., name, address, phone number) we receive will be shared only within the Sponsor and Loftwork, and will be handled in accordance with the privacy policy shown below.

    • Project Related Parties will not be liable for any loss or damage incurred by Applicants in connection with the Project.
    • All communication and connection fees related to the application process are the sole responsibility of the Applicant.
    • You may not be able to submit your application on some PCs, smartphones, tablets or other devices due to reasons including the model of the device, the operating system, or the web browser.
    • Please contact the respective operators for details on Instagram settings and usage.
    • The winners of the Project may not eligible to win prizes in other projects organized by Project Related Parties during the same period.
    • If there is any irregularity in the post for which the application is made, Project Related Parties may delete the relevant post. Please be aware that any application by the deleted post will be invalidated.
    • The Project uses the Instagram platform and API. Please be aware that system failures may occur and applications may not be submitted properly. Application submitted in the event of a system failure will not be verified by Project Related Parties, and will be deemed invalid.
    • In order to ensure the smooth operation of the Project, a system for the Project has been installed and is being operated. In the event of a failure of the system, your application may not be processed properly. Please be aware that should there be a failure, any application received during the occurrence of failure will be considered invalid as it cannot be verified by Project Related Parties.
    • The contents of the Project may be changed at any time without prior notice. The Rules may also be revised at any time at our discretion. In such cases, we will notify you of any changes to the contents of the Project or revisions to the Rules from time to time by posting a notice on the official account of our service. After such notice is given, such changes or revisions shall apply to all applicants for the Project as well as to us.
    • The Rules shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction in the first instance over any disputes related to the use of the Project and the Rules.
